"TAX MINIMISATION FOR PROPERTY INVESTORS"

Let me tell you in a nutshell what this seminar is about.

We have seen over the last few years the extraordinary profits that can be made by the purchase and sale of vacant land, flats, houses (including holiday houses) and business premises.

This phenomenon illustrates what canny investors have known for decades - that more people have become wealthy through astute property investment than by any other kind of investment. But there are dangers in property investment, and one of those dangers is the huge impact of tax, if there is no proper tax-planning.

Tax can make major inroads into your profits. If SARS assesses you to income tax on your property transactions, more than 40% of your profits may be lost to tax. Careful tax planning will minimise the amount of income tax and capital gains tax you pay on property transactions, and will maximise the tax deductions you can claim.

What the Seminar Will Provide

This seminar will provide you with specific, practical knowledge of how to minimise the amount of income tax and capital gains tax that you will pay on the purchase and sale of immovable property (in other words, land, flats, houses, business premises), irrespective whether you re-sell that property quickly, or hold onto it for many years before ultimately selling.

Who Will Benefit?

The seminar is designed both for professionals (attorneys, accountants, financial advisers, property developers etc) and for the lay person who wants to familiarise himself or herself with the principles of income tax and capital gains tax applicable to property transactions, and to learn about the do's and the don'ts of property investment from a tax point of view.

The Seminar Format

The seminar will include group discussion of a number of challenging practical case studies which illustrate how tax principles apply to real-life property transactions.

Leading High Court and Tax Court judgements are discussed which illustrate successful tax strategies and disastrous failures in tax planning. The seminar offers advice on how to utilise tax-saving methods which have proven to be successful, and how to avoid common tax traps.

Issues Discussed

This seminar will deal with the following vital issues -

  • should you buy property in your name, your spouse's name, in the name of a close corporation, company or family trust?
  • how to finance the purchase of property in the most tax-effective way
  • tax traps when purchasing property with borrowed money
  • tax traps when buying a property-owning company or close corporation
  • how to avoid being categorised by SARS as a "property speculator" and thus being liable to income tax on your profits
  • how to avoid having your property investments labelled by SARS as a "scheme of profit-making" and thus subject to income tax
  • how to maximize your tax-deductions on property investments
  • how to minimize capital gains tax when you sell the property
  • common tax traps in property investment and how to avoid them

Who should attend?

  • individuals who have invested or intend to invest in property (houses, flats, business premises, vacant land)
  • attorneys and accountants who advise clients on property transactions
  • property developers
  • financial advisers, investment advisers and bank managers
